Synopsis Undoubtedly, the Indian Judiciary has shown unprecedented initiative during the last few years and has succeeded in getting the support of the majority of people in the country. In spite of such huge public support, the dangers of judicial activism should not be underestimated. This development cannot be viewed merely as an advance in judicial review. A highly activist judiciary with an unlimited power of judicial review must be reconciled with the representative and majoritarian character of Constitutional Democracy.
