This is a critical study of India’s family laws which are based on principles of Hindu law. Modern India’s family and succession laws are constituted by the personal laws of the Hindus. They are the personal law, largely reformed and codified, of four major religious communities of India—the Hindus, Buddhists, Jains and Sikhs. The work offers a critical study of the provision of the Hindu personal law in a historical, constitutional and human rights perspective. The book mainly covers three broad issues: matrimonial law, family rights and relations, and property and succession laws, each beginning with the text of the governing statutes followed by an understanding and evaluation of their provisions. It cites a number of cases in the last two decades by the Supreme Court of India and various high courts covering all provisions of the four Hindu law Acts of 1955-56 and registering all legislative developments and judicial verdicts in recent years.
